Is gratuity paid on basic pay only?
Not under the labour codes. Gratuity follows the codes’ definition of wages: basic, DA, special allowance and other pay that is not on the list of exclusions, with excluded allowances above half of pay added back. This calculator shows both figures so the difference is visible.
When does part of a year count for gratuity?
A part-year of more than six months counts as a full year. Six months or less does not count.
Who qualifies for gratuity?
Five years of continuous service for a permanent employee, one year for a fixed-term employee, and no minimum on death or disablement.
